Amway India CMD lies to the journalists

The other day the CMD of Amway India Enterprises in an interview to a nitwit Indian journalist with straight face lied that the Amway India is not a chit fund company but an FMCG. What a laughable statement!
The CMD, Mr William Pinckney, has conveniently skipped the issue about the business model of Amway.
The Andhra Pradesh High Court has rightly pointed out that Amway's business model is illegal in its judgement in 2007.
The Honourable High Court stated, "It is, thus, evident that the whole scheme (of Amway India) is so ingeniously conceived that the inducement for aggressive enrollment of new members to earn more and more commission is inherent in the scheme.  By holding out attractive commission on the business turned out by the downline members, the scheme provides for sufficient inducements for its members to chase for the new members in their hot pursuit to make quick/easy money."
When a batch of criminal cases were filed against the fraudulent company under Section 2 (c) of the Prize Chits and Money Circulation Schemes (Banning) Act, 1978, it meant that the company is indulging in illegal business activity of money circulation scheme not under prize chits.
The High Court also stated, "Thus the two ingredients are satisfied in the case of promoter (Amway India) too.  We are, therefore, of the considered view that the scheme run by the petitioners squarely attracts the definition of “Money Circulation Scheme” as provided in Section 2(c) of the Act. (Para 35).
In spite of the clear judgement, the CMD has the gall to state that his company was not a chit fund company. Anyway who said that Amway India is a chit fund company.
It is a product-based money circulation scheme company.
It is high time people realised the dubious claims of the company and fall prey to its misleading propaganda.
Crooks say many things but how could a journalist take them for granted. The journalist should have checked for the criminal cases against the company. The journalist should have asked the police officials who filed criminal cases.
For reasons better known to them these journalists forget the basic tenets of journalism - Question.

Despite what the propagandists of
'Income Opportunity' racketeers keep insisting (and unqualified journalists keep repeating), independent Indian police officers, prosecutors and judges, have already worked out how fraudulent pyramid, or money circulation, schemes can be hidden behind effectively-unsaleable products, and/or services (often of a dubious pseudo-scientific nature).

Despite what it says on the label, the real function of 'Income Opportunity' wampum is merely to launder unlawful payments (based on the false expectation of future reward) into unviable investment schemes - without any significant, or sustainable, source of revenue other than their losing-victims.

Some of the key questions which the majority of mainstream journalists never ask, are:

Why is 'Income Opportunity' wampum so banal, yet so jaw-droppingly expensive?

Why are 'Income Opportunity' adherents forbidden (on pain of expulsion) to offer the wampum for sale in traditional retail outlets?

Why are 'Income Opportunity' adherents obsessed with recruiting more adherents?

Why do 'Income Opportunity' adherents keep giving their time and money to 'Income Opportunity' racketeers?

Why do all so-called 'Income Opportunities' hide effectively 100% loss/churn rates?

In the end, 'Income Opportunity' rackets are not that difficult to understand, provided observers are able to look beyond the ends of their noses.

Amway is operating in all states in India. Contrary to what has been suggested in certain quarters and in the media:

1. No Court in India has convicted Amway of any offense under the Prize Chits and Money Circulation Scheme (Banning) Act, 1978 or under the Indian Penal Code, 1860. Thousands of Amway distributors earn an income from selling Amway products. They work hard and deserve the respect of authorities across the country. Misleading statements about the Amway Business Model made by some authorities unnecessarily disparage them and their efforts.

2. Amway provides its distributors with the opportunity to sell a wide range of quality products. We stress to all distributors that this requires hard work and a significant commitment by them in terms of time and energy.

3. Amway pays commission based solely on product sales. Those Amway distributors who earn higher commissions have spent years developing their respective businesses. Success does not come overnight.

4. Many distributors earn more than the person who introduced them to the business.

5. It is free to join Amway and any product purchases are totally optional.

6. Consumers not completely satisfied with our product can return it within 30 days of date of delivery for full refund as per Amway’s refund policy. Additionally, those distributors who do not wish to continue in the business may return unsold inventory to Amway for a 100 per cent refund as per Amway’s refund policy.

7. All Amway products are recognized around the world as high quality. Amway group holds 1000 product and process patents worldwide with an additional 900 or more patent applications currently pending.

8. Ninety Five percent of Amway products sold in India are made here. They are all made to world class quality standards demanded by Amway, using Amway proprietary technology.

Soon Kerala will become the first state to pass law on MLM industry in India. The bill on MLM will be presented in the assembly in coming session. All the aspects related to the control and the operations of MLM companies in Kerala has been discussed and same to be presented in the assembly during the next session.

The Bill will clearly distinguish MLM and Direct Selling companies and exclude the latter from the Prize Chits and Money Circulation Scheme (Banning) Act, 1978.

Some time back, the ceo of Amway was arrested by Kerala authorities under PCMC act, and that caused lot of tension among other direct selling companies in India, some say, this might have triggered the formulation of the Bill.

The bill will eventually help direct selling companies from being charged under PCMC act.

The Bill was jointly drafted by industries secretary and along with representatives of home, law, commercial taxes and consumer affairs departments.

They recommended a constitution on mlm to regulate and same to be regulated by an authority in the state for the registration, control and supervision on MLM companies. The authority shall also have the same powers as are vested in a civil court under the code of civil procedures 1908 while trying a suit.

On the other hand, central government is already working with 7 member committee on a national level Bill to control the MLM business.
